Organisations that do not regard their aims and activities as political may nevertheless produce material which gives rise to the question of whether controlled expenditure has been incurred.
In such a case, if an organisation sends political material to its members on an issue that falls within the aims and objects of that body, the membership is not regarded as a section of the public for the purpose of Section 85(2) of the Political Parties, Elections and Referendums Act 2000. However, if the material also refers to matters outside the aims and objects of the body in question, that proportion of the material must be treated as election material.
