Where all expenditure incurred in preparing and distributing material to members of a union is met from a political fund, as provided for and in accordance with Part VI of the Trade Union and Labour Relations (Consolidation) Act 1992, members of the union would receive the election material as members of that union rather than as a section of the public or as individual members of the public at large. The expenditure, therefore, would not constitute controlled expenditure by a third party for the purposes of the Political Parties, Elections and Referendums Act 2000.
