What organisations should register as third parties?

In deciding whether or not to register as a third party an organisation should take particular account of the following provisions:

(a)   Election material is 'material which can reasonably be regarded as intended to' promote or procure electoral success for one or more registered parties or categories of candidates, or otherwise enhance the standing of any such party, parties or persons (Section 85(3), Political Parties, Elections and Referendums Act 2000 (PPERA)).

(b)   Material is election material even if it can reasonably be regarded as intended to achieve any other purpose as well (Section 85(3), PPERA).

(c)   It is immaterial, for the purpose of determining whether any material is election material, whether or not it expressly mentions the name of any party or candidate (Section 85(4), PPERA).

(d)   Promoting or procuring electoral success includes doing so by prejudicing the electoral prospects or standing of other parties or candidates (Section 85(4), PPERA).
