Schedule 2 of the DPA 2018 provides an exemption to data processing rules for the purposes of the prevention or detection of crime, and the apprehension or prosecution of offenders. Therefore, where you receive a request for information that you hold you will need to consider:
the person or organisation making the request,
the purpose of the request, and
the enactment quoted requesting access
If satisfied that the request meets the purpose detailed in Schedule 2 of the DPA 2018 then you should supply the data.
It should be noted that Regulation 107 of the RPR 2001 provides for the ERO to supply the full register to the council that appointed them. An employee or councillor of that council may disclose or make use of information contained in it where necessary for the discharge of a statutory function of the council, or in any other local authority relating to security, law enforcement and crime prevention. If the request relates to the council’s copy of the register, you should direct this to your council’s Monitoring Officer.
